Regular Council Meeting
April 10, 2008
The Village of Evendale Regular Council Meeting was called to order by Mayor Apking at 7:00 pm.
Roll call- The following council members were present: Ms. Carolyn Smiley-Robertson, Mr. Stiney Vonderhaar, Mr. Bill Puthoff, Jr., Mr. Jeff Albrinck, and Mr. John H. Ranz, Jr. and Mr. Doug Lohmeier. Also present were: Village Engineer, James Jeffers; Chief Fiscal and Accounting Office, George Snyder; Village Solicitor, Tim Burke; Fire Chief Rick Cruse and Village Clerk, Barb Rohs.
Mayor Apking presented Ordinance #08-18 - ORDINANCE APPOINTING MICHAEL J. ROA, MICHAEL K. HAUCK AND CHARLES W. RIELAGE AS LIEUTENANTS ON THE VILLAGE OF EVENDALE FIRE DEPARTMENT AND DECLARING AN EMERGENCY. Discussion: Ms. Smiley-Robertson addressed the numbers indicated on the Ordinance. Is should read in the 3rd Whereas…there be no more that a total of seven Captains and Lieutenants and the 4th Whereas…six Lieutenants and one Captain. Mr. Burke stated that after the first reading the wording should be amended. A motion to read Ordinance #08-18 by title only was made by Mr.Vonderhaar, seconded by Mr. Albrinck unanimously approved on roll call. A motion to amend the Ord. #08-18 with the correct number as stated above was made by Ms. Smiley-Robertson and seconded by Mr.
Lohmeier and unanimously approved on roll call. A motion to suspend the second and third readings of Ordinance 08-18 was made by Mr. Lohmeier, seconded by Mr. Albrinck and unanimously approved on roll call. A motion to adopt Ordinance 08-18 as an emergency was made by Ms. Smiley-Robertson, seconded by Mr. Lohmeier and unanimously approved on roll call. Mayor Apking declared Ordinance 08-18 adopted as an emergency.
The new fire Lieutenants were sworn in: Michael Roa and Charles W. Reilage. Introductions of family members and photos taken.
Proclamation was presented and read to Megan Seymour for her assistance in capturing the bank robbers at PNC in Evendale.
Chief Cruse thanked everyone for the support during the tragedy of losing fellow fire fighters in Colerain Township. Several Evendale fire fighters have volunteered their time to work in the Colerain Township to help out their departments.
Mayor Apking presented the consent calendar. Mr. Albrinck made the motion to accept the consent calendar. Seconded by Mr. Vonderhaar and unanimously approved.
Report of Mayor and Council Committees:
Mayor Apking reported that Cultural Arts Center asbestos abatement issue has been cleared up. Crews are now painting. May 9 is opening day. Many courses are being offered through the Center. Martha Carmody and her committee have worked very hard to get this all together.
Jeff Albrinck reported that tax revenues are up $500,000. The committee is evaluating the health benefit plan for the Village.
Doug Lohmeier reported that all the path lights are installed. The new trucks were in the front of building for viewing. P. Paff, ED at GHF, gave all council members the Board of Directors binder.
Stiney Vonderhaar reminded everyone that the Fine Arts Show is May 2-5. Griffin Nature Preserve cleanup date is May 10. GHF is hosting a volunteer appreciation pancake breakfast on April 19.
Mayor Apking reported that lights for the islands will be installed shortly. The additional lighting needed to finish the ground and rest of the village will be in the $200,000 to $220,000 range. There are other design options. This will be addressed in the April 29th Council Committee meeting.
Wild flower seed will be planted at Griffin Nature Preserve.
Mr. Ranz questioned when new street signs will be installed. James Jeffers is getting ready to advertise the bid.
Peggy Paff updated council on the success of Shear Fest. 1200 in attendance. 60 new and renewal membership. Summer camp has 230 of 300 summer camp slots already filled. Row by Row is May 18. This is a family fundraiser to kick off the market garden. All council members have or will have a reference manual. The new marketing piece was distributed to council members.
Presentation of Ordinances and Resolutions:
Mayor Apking presented Ordinance #08-17 ORDINANCE APPROVING WATER MANAGEMENT AND SEDIMENTATION CONTROL PLANS FOR DAN BEARD COUNCIL, INC AND AUTHORIZING BUILDING COMMISSIONER TO ISSUE PERMIT AND DECLARING AN EMERGENCY. Jack Cameron stated that this should only be the first reading. A motion to read Ordinance #08-17 by title only was made by Mr. Vonderhaar, seconded Mr. Albrinck by and unanimously approved on roll call. Mr. Ranz questioned if these plans had to be reviewed by Planning Commission. Mr. Jeffers stated that these plans are required under our code that and commercial operation that moves or fills more that 100 cubic yards must fill out an application. The purpose is that if the project goes
defunct and the village could fill back in or finish. The bond has to be accepted by council.
Mayor Apking asked about the Glendale Milford site, 3648 Glendale Milford Rd, and gigantic dirt pile. Mr. Jeffers stated that the plans are being redesigned for a smaller house. The original application was made May 22, 2007 and is good for one year. If the plans have not been resubmitted by the time the permit is one year old then the Village can order the owner to restore the site back to the original state.
Mr. Albrinck asked about house located on 3298 Brinton Trail and the moving of dirt. Mr. Jeffers stated that a seven day reminder letter was sent that all the restoration work has to be completed by the end of April. If not, Don Messer, Building Commission, has the ability to site them to Mayor’s court.
Motion- Schematic Design Plans- Dan Beard Council:
Doug Lohmeier stated the committee met and not all the requirements that were laid out in the lease have been met. The committee has made the recommendation to reject the submittal. Jack Cameron talked to the Dan Beard Council and Architects and they are working on getting all the components together for approval. Mr. Lohmeier made and read the motion to Council that rejects the Schematic Design Plans. Motion was seconded by Mr. Ranz and unanimously approved on roll call.
Mayor Apking presented Res # 08-07- Resolution setting a public hearing in May. Subject of the public hearing will be: Ord # 08-__ ORDINANCE AMENDING SECTION 1258.04 AND TABLE 1258.07-A OF THE CODIFIED ORDINANCES OF THE VILLAGE OF EVENDALE. This would change the parking lot size from 10 x 20 to 9 x 18 and it also reduces the aisle size. Mr. Puthoff questioned if that was the size we used at the Wal-Mart site. This is done to reduce parking lot size and water run off. The public hearing will be held before the May 8th council meeting.
Mayor Apking presented Ordinance # 08-19-ORDINANCE PROVIDING FOR THE ISSUANCE OF NOT TO EXCEED $4,110,000 OF TAX INCREMENT REVENUE RENEWAL NOTES BY THE VILLAGE OF EVENDALE, OHIO, IN ANTICIPATION OF THE ISSUANCE OF REVENUE BONDS, FOR THE PURPOSE OF FINANCING CERTAIN PUBLIC IMPROVEMENTS, AND DECLARING AN EMERGENCY. A motion to read Ordinance #08-19 by title only was made by Mr.Puthoff, seconded by Mr. Lohmeier and unanimously approved on roll call. A motion to suspend the second and third readings of Ordinance #08-19 was made by Mr. Lohmeier, seconded by Mr. Albrinck and unanimously approved on roll call. A motion to adopt Ordinance #08-19 as an emergency was made by Mr. Vonderhaar, seconded by Mr. Lohmeier and unanimously
approved on roll call. Mayor Apking declared Ordinance #08-19 adopted as an emergency.
Mayor Apking presented Ordinance #08-20- ORDINANCE CONFIRMING JAMES BOTHE AS SERVICE DIRECTOR/FOREMAN AND DECLARING AN EMERGENCY.
A motion to read Ordinance #08-20 by title only was made by Mr.Vonderhaar, seconded by Mr. Lohmeier and unanimously approved on roll call. A motion to suspend the second and third readings of Ordinance #08-20 was made by Mr. Lohmeier, seconded by Mr. Albrinck and unanimously approved on roll call. A motion to adopt Ordinance #08-20 as an emergency was made by Mr. Vonderhaar, seconded by Mr. Lohmeier and unanimously approved on roll call. Mayor Apking declared Ordinance #08-20 adopted as an emergency.
Mayor Apking presented Ordinance #08-21- ORDINANCE GRANTING PERMANENT STATUS TO SERGEANT JEFF MCDANIEL ON THE EVENDALE POLICE DEPARTMENT FIXING HIS SALARY AND DECLARING AN EMERGENCY. A motion to read Ordinance #08-21 by title only was made by Mr.Lohmeier, seconded by Mr. Albrinck and unanimously approved on roll call. A motion to suspend the second and third readings of Ordinance #08-21 was made by Mr. Puthoff, seconded by Mr. Lohmeier and unanimously approved on roll call. A motion to adopt Ordinance #08-21 as an emergency was made by Mr. Lohmeier, seconded by Mr. Vonderhaar and unanimously approved on roll call.
Mayor Apking declared Ordinance #08-21 adopted as an emergency.
Other business: There were no other items to go before Council
Motion to move into executive session is made by Mr. Vonderhaar, seconded by Mr. Albrinck and unanimously approved on roll call.
A motion to adjourn was made by Mr. Vonderhaar, seconded by Mr. Albrinck and unanimously approved. Council adjourned at 8:00 pm.
